Kanye West has become the target of a lawsuit after Robert “Bobby” Poindexter of the Persuaders filed a claim against the rapper in the United States District Court of Southern New York, on March 27th. According to Poindexter, West’s track ‘Girls Girls Girls (Remix)’ off of his 2006 mixtape ‘Freshmen Adjustment 2’ illegally samples the Persuaders 1973 song ‘Trying Girls Out.’
West apparently used a cleared version of the sample on Jay-Z’s 2001 album ‘The Blueprint’ where a remix of ‘Girls Girls Girls’ using the Persuaders instrumentals appears as a hidden track. But according to AHH, Poindexter expresses using the cleared version only indicates that Kanye West knew the sample was not cleared when he used it on his mixtape.
Poindexter says that he’s tried to resolve the dispute with West through an out-of-court settlement, but the rapper has not been willing to discuss a resolution. “I have offered to resolve this matter out of court with Kanye West. But in response, he has refused to even discuss any ‘out-of-court’ resolutions whatsoever. Nor has he provided any evidence that he is demanding others to cease and desist from selling the illegal version,” said Poindexter.
According to the lawsuit, Poindexter is looking to collect as much as $500,000 from the rapper in damages and says the rapper has used the track as instrument to promote his own music over the internet. Poindexter also claims that by not crediting him on the mixtape he was deprived recognition and earnings worth “an untold amount of dollars.”
